Discipline
Although the right to attend school is a civil right, fully recognized in the courts, it is not an absolute right. School officials have a limited authority to remove a student with a disability from his/her present school setting because of a violation of school rules, conduct which materially and substantially disrupts the rights of others to an education, or conduct which endangers the student, other students or staff, or the property of the school. Students with disabilities attending Parkway schools may be moved to an appropriate interim alternative educational setting, another setting, or suspension to the extent such alternatives are applied to children without disabilities. Such removals may be subject to certain procedures and limitations required by federal and state statutes and regulations, as well as Parkway policy.

This form documents the manifestation determination and how general and special education services will be provided. It is to be completed by the Parkway administrator immediately following a manifestation determination for a student with a disability or suspected disability. This form is to be sent to the Parkway Special Services Department or provided to the DRC, along with the Superintendent Suspension Discipline Review Committee Packet. A copy of the completed form also is to be kept in the student’s Class 2 file with the suspension letter.

Parkway Manifestation Determination Form (504 & Suspected Only) (Aug 2009)

This form is to be used for all manifestation determinations for students with Section 504 disabilities or suspected disabilities. This form is to be sent to the Parkway Special Services Department or provided to the DRC, along with the Superintendent Suspension Discipline Review Committee Packet. A copy also is to be kept in the student’s Class 2 file with the suspension letter. This form can be printed and information handwritten in or you may type the information into the grey boxes on the form.
